New rules for the placement of trees and shrubs on private land adjacent to neighboring territories have been introduced into the State Building Code of Ukraine. These changes took effect on October 1, 2019.
According to the new standard DBN B.2.2-12:2019, the distance from the property line to the bushes must be at least one meter. For trees, this distance depends on the size of the crown and varies between 4 and 6 meters. However, it must not be less than half the crown diameter. For example, if the diameter of the tree crown is 9 meters, the minimum distance to the property line should be 4.5 meters.
It should be noted that the new standards only apply to new plots and weekend homes. Owners of existing plantings do not have to remove trees that were previously planted.
With regard to other countries, international practice provides for different rules on this issue.
In France, the distance from the property line depends on the expected crown size of the mature tree and can range from 1 to 10 meters. In Germany there are also precisely defined rules regarding the height of trees and their placement.
In the USA the requirements are less strict than in European countries, but the minimum distance to the property line is between 2 and 5 meters. For large trees such as oaks and maples, this distance may be greater. In Asian countries, especially Japan, when determining the distance between trees, not only legal requirements but also aesthetic traditions are taken into account.
